[ 01 ] ACCEPTANCE OF TERMS

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Northeast Products LLC, a New Jersey limited liability company (“Company,” “we,” “us,” or “our”), located at 1405 US-46, Ledgewood, NJ 07852. By placing an order, submitting an inquiry, using our website, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

[ 02 ] PRODUCTS & SERVICES

Products Offered:
Northeast Products LLC specializes in the wholesale and bulk supply of landscaping materials (dump truck delivery within a 20-mile radius), including but not limited to:

+ Topsoil
+ Mulch
+ Compost
+ Hay

Services Offered:
In addition to our material products, we offer:

+ Green waste collection and recycling services
+ Consultation services related to product selection and use

Wholesale & Bulk Sales:
All sales are conducted on a wholesale and bulk basis. Minimum order quantities apply as follows:

+ Topsoil: Minimum 2 cubic yards per order
+ Mulch: Minimum 2 cubic yards per order
+ Compost: Minimum 2 cubic yards per order
+ Hay: Minimum 1 bale per order (optional add-on)

[ 03 ] PRICING, PAYMENT & TAXES

Website Pricing:
The prices listed on our website are the current, active prices for online purchases and represent the amounts customers will be charged at the time of transaction. All listed prices are firm and binding at checkout. However, Northeast Products LLC reserves the right to update or adjust product pricing at any time without prior notice to reflect changes in material costs, market conditions, operational expenses, or other factors. Price changes will take effect upon posting to the website and will not affect orders that have already been confirmed and paid. Customers are encouraged to review current pricing on our website before placing each order.

Quotes & Estimates:
For larger orders, pricing is available upon request by phone or email.

Payment:
Northeast Products LLC accepts the following forms of payment:

+ Credit Card: All standard orders may be paid by credit card. Credit card transactions are securely processed through Stripe. By providing your payment information, you represent that you are authorized to use the payment method provided and authorize us to charge the full amount of your order, including applicable taxes and delivery fees.

+ Check: Personal or business checks are accepted for large volume orders at the Company’s discretion. Checks must be made payable to Northeast Products LLC. Orders paid by check will not be processed or scheduled for delivery until the check has cleared.

+ Bank Transfer (ACH): Bank transfers are accepted for large volume orders at the Company’s discretion. Please contact us prior to placing your order to obtain banking details and to confirm eligibility for this payment method.

For the purposes of this section, “large volume orders” are determined on a case-by-case basis. Please contact us by phone or email to discuss payment options for your specific order.

Sales Tax:
All applicable New Jersey state sales tax will be collected at the time of purchase in accordance with New Jersey law.

Delivery Fees:
A flat delivery fee of $50.00 per dump truck delivery applies to all orders requiring delivery. This fee is in addition to the cost of materials and applicable taxes.

[ 04 ] DELIVERY

Delivery Area:
Delivery is available within a 20-mile radius of our facility at 1405 US-46, Ledgewood, NJ 07852. Orders outside this service area may not be accommodated. Please contact us prior to placing your order to confirm delivery eligibility.

Delivery Timeframe:
Orders will generally be delivered within two (2) business days of order processing and confirmation. Delivery timeframes are estimates only and are not guaranteed. Northeast Products LLC shall not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to weather conditions, equipment issues, or access restrictions.

Customer Delivery Responsibilities:
To ensure a successful delivery, the customer is responsible for:

+ Providing the exact drop-off location and delivery address at the time of ordering
+ Disclosing all entry requirements, access restrictions, gate codes, or security requirements
+ Identifying and communicating any known obstacles, hazards, or site conditions that may affect delivery
+ Ensuring the delivery site is accessible and safe for our dump truck and driver

Northeast Products LLC reserves the right to cancel or reschedule a delivery if site conditions are deemed unsafe or inaccessible upon arrival. In such cases, any restocking or redelivery fees may apply.

Delivery Execution:
All deliveries are performed using our in-house dump truck equipment. Northeast Products LLC is not responsible for damage to private property, driveways, lawns, or structures arising from delivery operations. It is the customer’s responsibility to ensure that the delivery location can safely accommodate a our delivery vehicle.

[ 5 ] ORDER CANCELLATIONS

The following cancellation policy applies to all orders:

+ Full Refund: Orders cancelled within twenty-four (24) hours of purchase are eligible for a full refund of the purchase price.
+ No Refund: Orders cancelled on the same day as the scheduled delivery date are not eligible for a refund.
+ All cancellation requests must be submitted by phone or email to Northeast Products LLC.

[ 6 ] NEW JERSEY SALES TAX

Northeast Products LLC is a registered business in the State of New Jersey and collects applicable state sales tax on all taxable transactions in compliance with New Jersey tax law.

[ 07 ] INTELLECTUAL PROPERTY

All content on our website, including but not limited to text, graphics, logos, images, and product descriptions, is the property of Northeast Products LLC or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

[ 08 ] LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Northeast Products LLC, its members, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your purchase or use of our products or services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms shall not exceed the total amount paid by you for the specific order giving rise to the claim.

[ 09 ] DISPUTE RESOLUTION

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your transaction with Northeast Products LLC, the parties agree to first attempt to resolve the matter through good-faith negotiation. Either party may initiate negotiation by providing written notice of the dispute to the other party. The parties shall meet and confer within a reasonable time following such notice to attempt resolution.

If negotiation fails to resolve the dispute within thirty (30) days of the written notice, either party may pursue available legal remedies.

[ 10 ] GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought in the courts of Morris County, State of New Jersey.

[ 11 ] MODIFICATIONS

Northeast Products LLC reserves the right to modify these Terms and Conditions at any time. Updated Terms will be posted on our website with a revised effective date. Your continued use of our website or services following any update constitutes your acceptance of the revised Terms.
